Dear Sir,
RE: DEFAMATORY STATEMENTS MADE TO THE CEYLON TODAY NEWSPAPER
I write on the instructions of my client Avant-Garde Maritime Services (Pvt) Ltd. of No.613, Bangalawa Junction, Pitakotte, Kotte.
My client also instructs me that Avant-Garde Maritime Services (Pvt) Ltd. is a leading firm in maritime security services providing a comprehensive range of total risk mitigation solutions to the global maritime industry. It is a signatory of the International Code of Conduct and a member of the Security Association Maritime Industry (SAMI) and the only ISO9001:2008 and ISO2800:2007 certified maritime security provider in the whole of Asia. It has commented internationally at many global forums such as the Galle Dialogue 2013 for successfully engaging in antipiracy operations. My client instructs me that there is a large number of employees out of which almost all are former military personnel thereby maintaining a very high standard in providing maritime security services.
My client instructs me that you have made libelous statements regarding my client to the Saturday Edition of Ceylon Today Newspaper which were published under the title "Avant Garde Boko-Haram Arms Deal Under Probe" and the same on the website www.ceylontoday.lk on 04th April 2015.
My client instructs me that the statements made by you are totally defamatory and/or defamatory per se and/or defamatory by innuendo of my client's reputation and are based on false, inaccurate and unclarified facts with malicious and malevolent intent to tarnish my client's unblemished reputation.
In the said circumstances, I have been instructed that my client needs to maintain my client's unblemished reputation and that the spiteful and unwarranted slander that it was subjected to due to the libellous statements by you have caused grave loss and damage to my client’s reputation, particularly references to:
Ø the supply of weapons to the Nigerian terror group Boko Haram;
Ø cloudy issues relating to the floating armories;
Ø investigations being expanded to cover suspected dealings with terror outfits in some African countries;
Ø the supply of weapons to the Nigerian Government;
Ø involvement in supplying of weapons to Ukrainian rebels;
Ø involvement in terror activities in the Maldives;
Ø the supply of weapons to the former Maldivian President
imprisoned on terrorism charges; and
Ø that the weapons on the floating armories were once owned by the
LTTE.
Therefore, I am instructed by my client to demand from you in damages a total sum of Rupees Twenty Billion (Rs.20,000,000,000/-) and the cost of the letter of demand Rupees Ten Thousand and Five Hundred (Rs.10,500/-) and therefore demand is hereby made that you pay the aforesaid sum within Fourteen (14) days of the receipt of this letter.
In the event of your failure to pay my client the said sum of Rupees Twenty Billion (Rs.20,000,000,000/-) and the cost of the letter of demand Rupees Ten Thousand and Five Hundred (Rs.10,500/-) within Fourteen (14) days of the receipt of this letter, I am instructed to institute legal action against you for the recovery of the same and legal interest from the date of the institution of proceedings and for costs.
